    This Privacy Policy explains how we collect your Personal Information and how we maintain, use and disclose that information. This Privacy Policy does not apply to parties that may be linked or associated with our website (for example, our Product Providers) and to whom you may disclose Personal Information. You agree to this Privacy Policy by accessing, browsing, or using this website. In this Privacy Policy:

    • Trade Fundingwe or us means Trade Funding Pty Ltd (ABN 28 647 543 084) and our employees, contractors, associates and any related entities.
    • Credit Information has the same meaning as defined in the Privacy Act 1988 (Cth) (Privacy Act).
    • Personal Information means any information or an opinion, whether true or not, and whether recorded in a material form or not, from which your identity is apparent.
    • Privacy Policy means this privacy policy available at https://www.tradefunding.com.au/privacy-policy, or through calling us on 1300 161 641 and requesting a hard copy.
    • Product Provider means the entities listed in the schedule available at https://www.tradefunding.com.au/privacy-policy or any other organisation not listed providing finance or payment products.
    • ‘customer’ refers to individuals who engage us to provide products and services to them or their business.

    • visitor’ refers to individuals who engage with us on our website, or who enquire about our functions or activities via electronic means.
    • applicantsrefers to individuals who apply for employment or other engagement with us.
    • ‘Sensitive Information’ is a subset of Personal Information and includes information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information, and biometric information (that is, data derived from your physical characteristics, such as a fingerprint) and biometric templates (that is, a stored digital template of biometric information, such as a fingerprint or retina scan). 

    What information do we collect and how do we collect it?

    We will generally collect Personal Information directly from you when you interact with us, such as in person, by email, by phone, by enquiry or feedback form, or via our website, social media channels, interviews (via any method), any of our standard forms (including application forms), contract negotiation, our employment and engagement application process, our surveys (where applicable), or any other means when you provide us with your Personal Information.

    We may also need to collect Personal Information about you from third parties from time to time where it is necessary for us to do so and it is unreasonable or impractical to collect directly from you, where you have consented to us doing so, or where we are otherwise required to or authorised to by law.  Those third parties include:

    • if you are a customer: publicly available records such as the Australian Securities Investment Commission, Australian Business Register, credit reporting bodies and our lending partners;

    • if you are a visitor: technology service providers and social media platforms;

    • if you are an applicant: referees when they provide references, academic institutions or training and certification providers, providers of licence and background-checking services, recruiters and other service providers who assist in the engagement process, and other publicly available sources such as social media platforms; and

    The kinds of Personal Information we collect about you depends on our relationship with you, and we limit the information we collect to what is reasonably necessary for one or more of our functions or activities.  

    Generally, we collect the following personal and business information in order to carry out the services offered by our website:

    • Personal Information such as name, e-mail address, mailing address and phone numbers
    • Credit Information
    • Information to confirm your identity, including but not limited to your driver’s licence, passport number and Medicare number 
    • If you are a visitor, records of your interaction with our website, such as your IP address, and any information that you may put into tools that we provide on our website (such as product selection tools or calculators)
    • Information about the Services you or your business has acquired
    • Business identifiers such as business name, ABN/ACN, address, size, industry, company structure, and other information
    • Financial and operating information such as turnover, sales channels, your payment history on other debt, and other information
    • Business and personal documentation – you may wish to provide business and personal documents for us to provide to Product Providers in order to facilitate your applications for financing. These documents may include (but aren’t limited to) tax statements, bank statements, and financial reports
    • Feedback provided by you on our website and services – we may explicitly request your feedback after your use of our website and services. We take our commitment to high-quality service seriously and hope you will provide us with frank and honest feedback that we will record and endeavour to act upon.
    • If you are an applicant with us depending on your potential or actual position with us, we will also generally collect your Personal Information contained within an application and CV/resume, employment history, personal information derived from a reference, personal information derived from an interview, personal information derived through testing (including psychometric or aptitude testing, as applicable), licences and other certificates and qualifications, and information included in a passport, birth certificate, visa or other documentation demonstrating your right to work in Australia.

    We will not seek to collect sensitive information (e.g., information on your health or criminal records, or your racial or ethnic background), unless it is necessary to carry out our services. If we do have to collect such sensitive information, we will do so in accordance with the Australian Privacy Principles under Australian law.

    ‍We support your ability to make decisions about the Personal Information you provide to us, however if you choose not to provide us with the information requested, or it’s incomplete or inaccurate, we may not be able to provide you with the information, goods, and services you are seeking.  If you are an applicant, refusal to provide Personal Information may mean we are unable to process your application.

    How do we use the information we collect?

    We will collect, use and disclose the Personal Information you have provided to us if it is reasonably necessary for or directly related to the performance of our functions and activities and to carry out our services and business operations to you, including:

    • Establishing and facilitating a relationship with you; 
    • Maintaining and managing our relationship with you, and communicating with you in the ordinary course of that relationship;
    • Supplying you with information, products and services;
    • Updating your Personal Information, including destroying or de-identifying it when it is no longer relevant (to the extent applicable); 
    • Conducting market research and monitoring use of our goods and services;
    • Source for you, or a company of which you are a director:

                  – Commercial credit for business purposes;

                   – Consumer credit for personal household, domestic or residential investment purposes

    • Introduce you to Product Providers who may be able to provide finance for your business
    • Discuss and compare different matched options with you, including different available products and Product Providers
    • To facilitate the verification of your identity
    • Deal with complaints, requests, or issues you may have with our website or services
    • Review your past interactions with us for the purposes of improving our website, products and service levels
    • Monitor your credit conduct
    • Conduct credit checks and analytics including but not limited to, financial ratio analysis. We will use these analytics to better inform us, you, your financial advisers, and our lending partners (see immediately below) about your creditworthiness and ability to service debt.
    • Provide Product Providers with information they need to contact you in order to discuss financing options.
    • Provide Product Providers with information and supporting documentation to support your application with that Product Provider
    • Support a guarantor application that you provide
    • Provide you with email alerts, including summaries of your activity with Trade Funding. We may also allow users to subscribe to email newsletters from time to time and may transmit emails promoting Trade Funding or third-party goods, services or content. Registered customers have the ability to opt out of receiving our promotional emails and to terminate their newsletter subscriptions by following the instructions in the emails at any time. Opting out in this manner will not end transmission of service-related emails, such as email alerts.
    • if you are an applicant, considering your application with us.
    • Respond to requests from regulatory bodies or authorities.

    We may collect your Personal Information from third parties, such as product providers, finance consultants, accountants, auditors, valuers, aggregators, conveyancers, legal advisers, insurers and mailing services, credit reporting agencies, associated or related entities, Industry bodies, tribunals, courts and similar to facilitate our provision of Services to you.  See Exchange and disclosure of personal information below. We may use or disclose Personal Information for secondary purposes where it would be reasonable to expect us to do so, and that secondary purpose is related (or directly related in the case of Sensitive Information) to the primary purpose set out above.

    If you provide us with Personal Information about someone else, you must ensure that you are authorised to disclose that information to us and that, without us taking any further steps required by applicable privacy laws, we may collect, store, use and disclose such information for the purposes described in this Privacy Policy.  Where we request you to do so, you must assist us with any requests by the individual to access or update the Personal Information you have collected from them and provided to us.

    Exchange and disclosure of personal information

    We may disclose your personal information to:

    • Product providers;
    • Any person who is a guarantor or proposes to be a guarantor;
    • Any organisation providing verification (including online verification) of your identity;
    • Any organisation or individual providing services enabling us to place your credit application with a Product Provider;
    • Finance consultants, accountants, auditors, valuers, aggregators, conveyancers, legal advisers, insurers and mailing services;
    • Our associates, related entities and contractors;
    • Industry bodies, tribunals, courts or other parties in connection with any complaint or compliance investigations regarding our services;
    • Any entity where we are required by law to do so; or
    • Any person considering acquiring, or who has acquired, an interest in our business or assets.

    Other disclosure to 3rd parties

    We may collect and disclose your information from and to third-party contractors that provide services to Trade Funding. In such circumstances, your information will be treated as confidential and private, and not used for any purpose other than that which is authorised by Trade Funding.

    Additionally, Trade Funding may share Personal Information about our user base with carefully selected third parties, so they can offer goods and services that may be of interest to you. If you do not wish to receive offers from such third parties, you will be able to opt-out of these communications through your user account.

    Aside from the disclosures set out above, we may also make disclosures as required and authorised by law. You acknowledge that we may disclose information you provide if required or authorised to do so by law, or if we, in our sole discretion, believe that disclosure is reasonable to:

    • Comply with Australian law
    • Accord with requests or orders from law enforcement
    • Comply with a legal process
    • Protect or defend Trade Funding’s rights or property, or a third party’s rights or property

     

    Combination of information with external data sources

    From time to time, we may gain access to external data sources that includes information about our customers. We may combine that data with the personal and business information collected above in order to carry out our business purposes. In circumstances where we gain information from an external source, it will only be used for the specific purpose for which it was provided to us by the external source.

    Storage and Security of Personal Information

    We store your Personal Information in different ways, including in paper and electronic form.  We take all reasonable measures to ensure your Personal Information is stored on secure servers (which may be based in Australia or overseas) in a manner that reasonably protects it from interference, misuse and loss and from unauthorised access, modification or disclosure, including electronic and physical security measures, including:

    • limiting access to the Personal Information we collect about you;
    • only providing access to Personal Information once proper identification has been given; and
    • requiring third party providers to have acceptable security measures to keep Personal Information secure.

    When we no longer need your Personal Information for the purpose for which we collected it, we will take reasonable steps to destroy or permanently de-identify your Personal Information.  However, most of the Personal Information is or will be stored and kept by us for a minimum of seven years (unless legislation requires us to destroy or permanently de-identify it sooner).

    Trade Funding maintains security measures to protect against loss, misuse or un authorised alteration of information stored in our database. We will exercise care in providing secure transmission of information between your computer and our servers, but we cannot ensure or warrant the security of any information submitted via the internet.

    Cross border disclosure of Personal Information

    We may hold or process the information collected from you on servers located overseas, including for storage, hosting, analytical, reporting, testing, and filtering purposes. If we do this, we ensure that the organisations providing the servers have appropriate data handling and security standards to comply with this policy.

    In some circumstances, we may also disclose Personal Information to parties operating outside Australia. Where this occurs, we take steps to protect Personal Information against misuse or loss and to comply with local law in respect of the transfer of your data from one jurisdiction to another. Those parties, in turn, may make such information available to the governments of such other countries in accordance with local law requirements.

    The countries where your Personal Information may be held or exchanged include the United States, the Philippines and in Australia.

    By using our website and services and providing us with your Personal Information, you consent to the disclosure of your Personal Information to locations outside Australia, including the countries listed above.

    Correction of information

    To ensure that our product and service offering is most appropriate to your situation, it is important for us, and for you, that the information we hold about you and your business is accurate. We request that you contact us with any updates to keep this information up to date. We will take reasonable steps to correct the information if we agree that it is incomplete, out of date, or inaccurate. 

    Access to your information

    You may request access to the information that we hold about you through the contact details on our website. We will process your request within a reasonable time, which will depend on the nature and size of the request. There is no fee for making a request for information. However, we may charge you the cost of processing your request (for example, an hourly rate of the person assigned to collate your information, and any out of pocket expenses such as photocopying).

    In some circumstances, where empowered to or required to by law, we may refuse access to certain Personal Information. If we refuse access to any Personal Information, we will give you notice of the reasons for refusal.

    In order to protect the confidentiality of your Personal Information, details of your information will only ever be passed on to you where we are satisfied that the information relates to you.  Accordingly, we may request documentation from you which confirms your identity before passing on any Personal Information which relates to you.

    We may choose to amend this policy from time to time and the current version will always be available on our website at www.tradefunding.com.au.
